polit3 — Terms of Service

These Terms of Service ("Terms") govern your access to and use of polit3.com and any related services provided by Polite Marketing LLC, doing business as polit3 ("polit3," "we," "us," or "our"), including our platform for mediating and curating partnerships between restaurants and content creators/influencers ("Services"). By accessing our website, submitting an inquiry, signing a retainer agreement, or otherwise using our Services, you ("you," "Client," "Creator," or "User") agree to be bound by these Terms. If you do not agree, do not use our Services.
1. Description of Services
polit3 operates a micro-influencer marketing platform that connects restaurants and hospitality businesses ("Restaurant Partners") with content creators ("Creators") for promotional partnerships, including gifted collaborations and paid retainer campaigns. Services may include, but are not limited to:
Sourcing and vetting creators for restaurant campaigns
Managing campaign logistics, communications, and scheduling
Providing tiered service packages (e.g., Starter, Growth, Launch)
Reporting on campaign performance
polit3 acts as an intermediary/facilitator and is not a party to the underlying agreement between a Restaurant Partner and a Creator unless separately and explicitly stated in a signed agreement.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use our Services. By using our Services, you represent that you meet these requirements and, if acting on behalf of a business, that you have authority to bind that business to these Terms.
3. Client Accounts and Retainer Agreements
Services are generally provided under a retainer agreement outlining scope, tier, term, and fees. These Terms supplement, and in the event of direct conflict on commercial terms are superseded by, a signed retainer agreement or statement of work.
You agree to provide accurate business information and timely cooperation (e.g., reservations, comped items, campaign approvals) necessary for us to perform the Services. Fees are due as outlined in your retainer agreement. Late payment may result in suspension of Services.
4. Creator Participation
Creators participating in campaigns facilitated by polit3 agree to fulfill agreed-upon deliverables (e.g., posts, stories, reviews) in good faith, in accordance with FTC guidelines on material connections and sponsored content disclosure (e.g., #ad, #sponsored, #gifted where applicable).
Creators are independent content creators, not employees, agents, or representatives of polit3 or the Restaurant Partner, unless otherwise agreed in writing. polit3 does not guarantee specific content performance, reach, engagement, or sales outcomes resulting from Creator content.
5. Mobile Message Program Terms (SMS/Text Messaging)
Program Name: polit3 Campaign Alerts
Program Sponsor: Polite Marketing LLC, doing business as polit3 ("polit3")
5.1 Program Description
polit3 Campaign Alerts is a recurring text messaging program for Restaurant Partners, Creators, and prospective clients who provide their mobile number to polit3. If you opt in, you may receive text messages that include:
Campaign coordination, scheduling, and confirmation messages
Reservation, visit, and comped-item logistics
Content deliverable reminders and approval requests
Creator/Restaurant Partner matching and introduction updates
Account, onboarding, and invoicing notifications
Replies to inquiries you submit to us
This is a recurring messages program.
5.2 How to Opt In
You may opt in to polit3 Campaign Alerts by submitting your mobile number through a form on polit3.com with the messaging consent box checked, by texting a polit3 keyword to our program number, by providing your mobile number in a signed retainer agreement or onboarding document that includes messaging consent language, or by otherwise providing your mobile number to us and affirmatively agreeing to receive texts.
Consent to receive marketing or promotional text messages is not a condition of purchasing any goods or services from polit3.
By opting in, you represent that you are at least 18 years old and that you are the subscriber or customary user of the mobile number you provide, and are authorized to consent to receive messages at that number. If your number changes or is reassigned, you agree to notify us promptly.
5.3 Message Frequency
Message frequency varies based on your campaign activity and account status. You may receive up to [INSERT NUMBER, e.g., 10] messages per month.
5.4 Message and Data Rates
As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
5.5 How to Opt Out — Cancellation
You can cancel the SMS service at any time. Just text "STOP" to the number from which you received our messages. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
5.6 Help and Customer Support

5.7 Carrier Liability
Carriers are not liable for delayed or undelivered messages.
5.8 Supported Carriers
Compatible carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Virgin Mobile, Cricket, and other carriers as supported. Carriers are not liable for delayed or undelivered messages, and carrier support may change without notice.
5.9 Privacy

5.10 Voice Calls (Separate from SMS)
By providing your phone number to polit3, you also consent to receive calls from us related to campaign coordination, account updates, and service communications. You may request removal from call communications at any time by emailing rafael_g@polit3.com or by telling the caller you wish to be placed on our internal do-not-call list. Opting out of SMS does not automatically opt you out of calls, and opting out of calls does not automatically opt you out of SMS — you may request either or both.
5.11 Changes to the Messaging Program
We may modify or terminate the polit3 Campaign Alerts program at any time. Where required, we will notify you of material changes through the program or on polit3.com.
6. Fees, Payment, and Refunds
Fees for Services are set out in the applicable tier or retainer agreement and are due as invoiced. Unless otherwise stated in a signed agreement, fees are non-refundable once campaign work or creator outreach has commenced. polit3 reserves the right to modify pricing for future terms with reasonable notice; existing signed retainer terms will be honored through their stated term.
7. Intellectual Property
Client/Restaurant Content: Restaurant Partners retain ownership of their brand assets, logos, and materials provided to polit3 or Creators for campaign use, and grant polit3 and participating Creators a limited license to use such materials solely for the purposes of the campaign.
Creator Content: Ownership and usage rights of content created by Creators (photos, videos, posts) are governed by the specific agreement between the Creator and Restaurant Partner/polit3. Absent a specific agreement, Creators retain ownership of their original content, subject to the usage rights granted for the campaign (e.g., repost, boost, or ad usage rights).
polit3 Materials: All website content, platform tools, branding, and proprietary materials of polit3 are owned by polit3 and may not be copied, reproduced, or used without our written permission.
8. Prohibited Conduct
You agree not to:
Use our Services for any unlawful purpose or in violation of any applicable law or regulation
Misrepresent your identity, business, or affiliation
Attempt to circumvent polit3 to directly solicit a Restaurant Partner or Creator introduced through our Services during an active campaign term, without our written consent
Post false, misleading, or undisclosed sponsored content in violation of FTC guidelines
Provide a mobile number you are not authorized to enroll, or use our messaging program to send unlawful, harassing, or unsolicited content
Interfere with or disrupt the operation of our website or Services
9. Disclaimers
Our Services and website are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or that any particular business outcome (e.g., increased sales, engagement, or reservations) will result from a campaign. We do not warrant that text messages will be delivered on time or at all.
10. Limitation of Liability
To the maximum extent permitted by law, polit3 and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of our Services, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount paid by you to polit3 in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless polit3 and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, or your content or conduct in connection with the Services.
12. Independent Contractor Relationship
Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between polit3, Restaurant Partners, and Creators. Each party is an independent contractor.
13. Termination
We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, including for violation of these Terms. Retainer agreements may include their own termination and notice provisions, which will govern in the event of conflict.
14. Governing Law and Dispute Resolution
Polite Marketing LLC is organized under the laws of the State of Illinois. These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of such courts.
15. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date reflects the most recent revision. Continued use of our Services after changes constitutes acceptance of the revised Terms.
